Mohammed Kadmiri: The First Judicial Officer of Morocco’s Territorial Collectivities

Mohammed Kadmiri has been appointed judicial officer of all the Kingdom’s local authorities. This appointment was decided by the Interior Minister on June 17, 2020 and published in the Official Gazette on Thursday, July 16, 2020.

The latter are faced with numerous litigation files whose management is proving difficult because of the lack of human resources.

According to the Court of Auditors, which published a report in 2018 on the management of litigation of local authorities: “the total number of judgments and final judgments handed down to these entities exceeds 3,940 during the period from 2011 to 2016”. However, it should be pointed out that the local and regional authorities’ judicial officers were not appointed.”

In 2015, the State instituted the judicial agent of the local authorities through the organic laws on advanced regionalization. The first appointment took place on June 17, 2020 and concerns Mohammed Kadmiri.

Mr. Kadmiri is 56 years old and holds a degree in public law and a master’s degree in sports management.

His administrative career began in 1988, at the Directorate of Local Government, before being put in charge of the Administrative Affairs and Coordination Division in 1993.

Five years later, Mohammed Kadmiri was appointed head of the Public Relations Department, a position he held for 16 years. He was then appointed by His Majesty King Mohammed VI as Secretary General of the Central Administration of the Ministry of the Interior in 2014.

From now on, Mohammed Kadmiri will be a judicial officer of the local authorities and will be responsible for providing legal assistance and representation.

According to the Interior Minister’s order n°1555.20, published in the Official Gazette this Thursday 16 July: “the judicial officer is empowered to plead before all courts of law in all cases except for disputes related to administrative control, in accordance with the conditions laid down in the three organic laws and any agreements established between the local authorities and the judicial officer”.

The latter also has the possibility of authorizing signature to the heads of departments of the Directorate of Local Institutions. And if necessary, to authorize the representatives of the regions to sign at the level of the wilayas of the regions.

In addition, the judicial officer of the local authorities has the possibility, in accordance with the provisions of article 3 of the said Order, to appoint lawyers to represent him before various courts.
